Welcome to our luxury fashion marketplace. These Terms and Conditions (“Terms”) govern your use of our website and services, as well as your purchases of products through our platform. By accessing or using our site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should discontinue use of our site.

Please read these Terms carefully. They set out the rights and responsibilities of all users (“you” or “Customer”) and those of lurfe.com (referred to as “the Company,” “we,” “us,” or “our”). The Company operates this online marketplace platform from Hong Kong. We provide a place for independent third-party sellers to offer products for sale and for customers to purchase them. By creating an account or placing an order, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a legal agreement.

Throughout these Terms, when we refer to “Site” or “Marketplace,” we mean our e-commerce website and related services. “Seller” refers to an independent third-party vendor using our platform to sell products. “Buyer” refers to the user purchasing products. Additional policies (like our Privacy Policy, Return Policy, or others referenced) are considered part of these Terms. If you have any questions about these Terms, please contact us before using the site or making a purchase.

1. Marketplace Overview and Role

1.1 Our website acts as an online marketplace that connects buyers with third-party sellers who offer fashion products. We specialize in luxury and designer-inspired items.

Please note: many of the products offered are “replica” or “high copy” items. This means they are high-quality copies of branded fashion goods, not original products from the brand owner. The sellers on our platform source and provide these items.

1.2 Third-Party Sellers: When you buy a product on our site, you are purchasing from an independent seller, not directly from our Company. We facilitate the transaction as an intermediary. Essentially, the sales contract for the product is between you (the Buyer) and the Seller. Our platform’s role is to host the listings, process the payment on the seller’s behalf, and coordinate the order process (including customer service support). We do not own, manufacture, or direct the creation of the products sold by third-party sellers.

1.3 Product Listings: Product descriptions, images, and prices are provided by the sellers. We require sellers to be as accurate as possible in describing items. However, because the sellers are independent, we do not guarantee that every listing is perfectly accurate, complete, or up-to-date. (For example, a seller might have a limited quantity and if it sells out, the listing may briefly remain active before update.)

We reserve the right to correct any errors, inaccuracies, or omissions (including after you have submitted an order).

1.4 No Agency: Neither the seller nor the buyer is considered an employee, agent, or representative of our Company by virtue of using the marketplace. We do not endorse any particular seller or product, though we do vet sellers to a reasonable extent. Sellers are responsible for ensuring their listings do not violate any laws or third-party rights.

1.5 Support: We strive to maintain a high-quality experience. Our customer service team will assist in communications between buyers and sellers if issues arise (such as delayed shipments, disputes, or.  returns). While the primary responsibility for product quality, shipping, and compliance lies with the seller, we will do our best to facilitate a fair resolution for any problems.

2. Product Authenticity and Brand Disclaimer

2.1 Replicas and High Copies: The products available on our marketplace are replica or “high copy” items. This means the items are unauthorized reproductions of designs from luxury brands. They are not manufactured or licensed by the original brand companies. In other words, these products are not officially licensed by the brands they imitate. Sellers attempt to produce high-quality copies that closely resemble the originals, but they are not the genuine products of those brands.

2.2 No Affiliation with Brands: We are not affiliated, associated, or endorsed by any of the designer brands that may be mentioned or referenced on our site. All product names, logos, and trademarks belong to their respective owners, and any use of these is purely for identification or descriptive purposes to inform customers of the style or type of product being offered. The use of brand names or marks on our site does not imply any affiliation or endorsement by those companies. For example, if a listing mentions “Style inspired by miu miu,” it’s only to indicate the product’s fashion inspiration, not that it’s an official product of that brand.

2.3 Intellectual Property Rights: We respect intellectual property rights of brand owners. By offering replica items, we do not intend to infringe on any trademarks. Sellers on our platform affirm that the items they sell are clearly presented as non-original, and buyers acknowledge that they are purchasing replicas.

All brand trademarks referenced remain the property of their respective owners, who are not affiliated with our website or our products.

If you are a brand owner and have concerns about any listing, please contact us; we have procedures to handle IP complaints and may remove listings that violate intellectual property laws.

2.4 Product Quality and Expectations: While replica products can be of high quality, they may not have the same materials, craftsmanship, or durability as the authentic product. There might be subtle differences in construction or materials. Buyers should set expectations accordingly. We make no guarantee that a replica will match the exact quality or performance of an official product. However, sellers are expected to provide the best possible quality and to accurately represent the item’s materials (for example, if an item is genuine leather or synthetic, etc., it should be stated).

2.5 Accuracy of Descriptions: We require sellers to provide clear images and honest descriptions. However, we cannot warrant that all product information is entirely accurate or error-free. Minor discrepancies might occur (such as slight color variations due to screen display or lighting in photos). The following are some specific disclaimers regarding product listings:

– Colors and details as shown in photos may appear slightly different in person due to lighting or display settings. – Measurements are approximate. Small differences (generally within a reasonable tolerance) may occur.

– Packaging of the product may vary or differ from any brand-name packaging, since these are unbranded replicas. – Any “logos” or brand markings on replicas are for realism but do not indicate authenticity.

If a product you receive is significantly not as described in the listing, please refer to the Returns and Refunds section below for how we handle such cases.

2.6 Pricing of Replicas: Replica items are typically sold at a fraction of the price of the genuine branded item. The price reflects the fact that you are not buying an official branded product. We believe our sellers’ pricing is fair for the quality offered, but it’s important to realize you are not paying for the brand’s trademark value or official warranty.

3. Account Registration and User Obligations

3.1 Account Creation: To make purchases or access certain features, you may need to create an account on our site. When creating an account, you agree to provide truthful, accurate, and complete information about yourself. This includes a valid email address and accurate shipping information. You also agree to keep this information up-to-date (for example, if you move to a new address or change your email).

3.2 Account Security: You are responsible for maintaining the confidentiality of your login credentials. Do not share your password with others. If you suspect any unauthorized use of your account (for instance, if you notice unfamiliar orders or account changes), you must notify us immediately. We recommend using a strong, unique password and changing it periodically to enhance security.

3.3 One Account Per User: Each customer should have no more than one account. You may not create multiple accounts to bypass any restrictions or to obtain unintended benefits (such as multiple sign-up coupons). We reserve the right to merge or deactivate duplicate accounts.

3.4 User Eligibility: By registering or using our services, you represent that you are legally capable of entering into binding contracts. If you are under the age of majority in your country, you must only use the site under the supervision of a parent or legal guardian, who agrees to these Terms on your behalf. We reserve the right to ask for age verification if needed.

3.5 Prohibited Activities: You agree not to engage in any activities on our site that are unlawful, harmful, or violate the rights of others. This includes, for example:

– No Fraud or Illegal Use: You will not use our platform to commit fraud, engage in money laundering, or for any illicit purpose. You will not purchase items with a stolen credit card or false information. – No Violation of Others’ Rights: You will not attempt to sell unauthorized or illegal products (if you are a seller) or post content (such as reviews or comments) that infringes on copyrights, trademarks, or privacy/publicity rights of others.

– No Interference: You will not introduce viruses, worms, or any other malicious code to the site. Also, you will not attempt to disrupt or overload our infrastructure (no DOS attacks, automated bots scraping excessively, etc.).

– No Harassment or Abuse: You will treat other users, sellers, and our staff with respect. Any form of harassment, hate speech, discrimination, or abusive behavior on our platform (including through messaging or in reviews) is strictly prohibited. – No Circumvention: You will not try to circumvent fees or the intended process of the marketplace. For example, you should not attempt to contact a seller to arrange a purchase outside the platform (doing so not only violates these Terms but also forfeits any buyer protection we offer for transactions).

3.6 Account Suspension or Termination: We reserve the right to suspend or terminate your account at our discretion if we suspect you have violated these Terms or engaged in fraudulent or harmful activity. In most cases, we will attempt to notify you of the issue and work with you to resolve it, but in serious or repeat cases, suspension may be immediate. If your account is terminated, you may lose any promotional credits or pending orders, as well as access to your order history on the site. (This does not eliminate any valid legal obligations you may have, such as payment of any outstanding amounts.)

3.7 User Content: If our platform allows you to post content (for example, product reviews, ratings, or Q&A), such content must be based on your real experience and must not be false or misleading. By posting any content, you give us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with our services. We reserve the right to moderate, edit, or remove user content that violates our guidelines or policies. You remain solely responsible for the content you post.

4. Orders and Acceptance

4.1 Placing an Order: When you place an order for a product, you are making an offer to buy that product from the seller at the listed price, under these Terms. Once your order is submitted, you should receive an order acknowledgement email. This email is not an acceptance of your offer; it is confirmation that we received your order request.

4.2 Order Acceptance: The contract of sale between you and the seller is formed only when we (on behalf of the seller) send you a confirmation email that the product has been dispatched. Up until that point, we reserve the right to decline or cancel your order for any reason. Possible reasons for non-acceptance can include: the item being out of stock, inability to obtain payment authorization, suspicion of fraud, or errors in product information (including pricing errors).

4.3 Cancellation by Company or Seller:

– If an item is out of stock or discontinued, the seller or we may cancel that item from your order. We will inform you and process a refund if you have been charged.

– In the event of a pricing error or technical mistake (for example, a $500 handbag listed for $5 due to a typo), we reserve the right to cancel the order even after confirmation. We will of course refund any amount you paid and explain the situation. We know mistakes can be disappointing, but as per industry standard, obvious pricing errors are not binding. – We may also cancel an order if we suspect it is high risk or fraudulent (e.g., unusually large orders from new customers with mismatched info). This is to protect all parties. If you believe your order was canceled in error, please contact support to verify your details and we’ll be happy to reinstate the order if appropriate.

4.4 Cancellation by Customer: If you change your mind shortly after placing an order, you may request a cancellation by contacting us as soon as possible. We will do our best to accommodate, but if the order has already been processed or shipped, we might not be able to cancel it. In such cases, you may need to proceed with a return (see Returns section). Customized or made-to-order items may be non-cancellable once production has started, as indicated on the product page if applicable.

4.5 Payment and Billing: All orders must be paid in full at the time of purchase (unless we explicitly offer cash-on-delivery for certain regions, which is rare). By providing payment information, you represent and warrant that you are authorized to use the payment method and that you authorize us (and our third-party payment processors) to charge the full order amount, including any applicable taxes and shipping fees.

4.6 Pricing and Currency: Prices are listed in the currency stated on the site (for a Hong Kong-based site, this is typically Hong Kong Dollars (HKD) by default, unless you select a different currency option). The price you see at checkout is the price you pay (plus any calculated shipping and applied discounts). Our prices do not include any foreign transaction fees your bank might charge or any import duties/taxes for international orders – those are separate and covered below. We strive to ensure accurate pricing at all times. If you see a price that seems obviously incorrect, please let us know. We are not obligated to honor prices that are clearly in error (for example, a missing digit making a price 90% off).

4.7 Taxes: For orders shipping within Hong Kong, currently there is no sales tax (Hong Kong does not impose VAT/GST on goods). If we are required by law to collect any other taxes or fees, those will be added at checkout and clearly shown. For international orders, see the Section on Shipping & Import Duties.

4.8 Payment Processing: Payment transactions are securely processed via our payment partners. If you pay by credit/debit card, the charge may appear under our Company name or our payment gateway’s name on your statement. If the payment fails or is disputed (chargeback), we may cancel the order. We reserve the right to request additional verification or proof of identity for certain orders (for example, high-value orders or if the billing and shipping addresses are in different countries).

4.9 Electronic Communication: You agree that email and site notifications can be used for communications about your order. It is your responsibility to provide a valid email and check it for order updates. We are not liable for any issues arising from missed communications due to outdated contact information or spam filtering.

5. Shipping, Delivery, and Import Duties

5.1 Shipping Regions: We offer worldwide shipping to many countries. During checkout, available shipping destinations and methods will be shown. If your country is not listed, unfortunately we might not ship there at this time.

5.2 Order Processing Time: After your order is confirmed and paid, the seller will prepare your item for shipment. Processing times vary by product and seller – for ready-stock items, it’s usually 7-14 business days.

If an item has a longer preparation time (like a custom piece or pre-order), it will be noted on the product page.

5.3 Delivery Methods: We use reputable courier partners for delivery (such as Hongkong Post, DHL, FedEx, UPS, or local couriers depending on destination). At checkout, you’ll be able to choose from available shipping options (standard, express, etc.) with estimated delivery timeframes. Once shipped, you will receive a tracking number so you can monitor the delivery progress.

5.4 Delivery Times: Estimated delivery times are provided for guidance and are not guaranteed, as they can vary due to factors beyond our control (e.g., postal delays, customs clearance, weather events). We will do our best to meet the estimates. If you haven’t received your order within a reasonable time beyond the estimate, please contact us and we will assist in investigating the delay.

5.5 Shipping Costs: Shipping fees will be calculated and shown at checkout. These fees depend on the destination, weight/size of the package, and the shipping method chosen. Occasionally, we may offer free shipping promotions – any conditions for those will be indicated (such as a minimum order value or limited-time offer).

5.6 Customs and Import Duties: For international shipments (outside of Hong Kong), import duties, taxes, or customs charges may be levied by your destination country. These charges (if any) are not included in our product or shipping prices. You as the buyer are responsible for paying any import duties or taxes imposed by your local customs authority. Unfortunately, we have no control over these fees, as they are determined by your government’s import policies. We recommend you check with your country’s customs office to determine what these additional costs might be before placing an order, if you are unsure. If customs fees are required, the courier may hold the package until you pay the fees. Non-payment might result in the package being returned or destroyed; in such case, we may not be able to refund shipping costs.

5.7 Customs Declarations: We (or the seller) will fill out the necessary customs declaration forms for your shipment. Generally, the item will be described in generic terms (e.g., “fashion accessories”) with an honest value. We will not falsify customs documents (for example, marking an item as a “gift” or undervaluing it) as that is illegal.

5.8 Risk of Loss: Ownership and risk of loss for items you purchase pass to you upon delivery to your address (or upon pickup if you arranged that). This means that once the package is delivered, you are responsible for it. If a package is lost in transit or damaged upon arrival, please inform us immediately so we can work with the courier and seller on a resolution (see Damaged or Lost Shipments below). Until the item is delivered, the seller (and by extension, our platform) bears the risk and we will ensure you either receive your item or are refunded.

5.9 Delivery Issues: If a package is marked as delivered but you did not receive it, check with others in your household or building, and your neighbors. It’s possible a delivery was left in a safe location or with building management. If it’s still not found, contact us and we will file a trace with the courier. We will work with you in good faith to locate the package or provide a solution.

5.10 Undeliverable Packages: Please double-check your shipping address during checkout. If a package is returned to us (or the seller) because the address provided was incorrect or incomplete, or if the package was unclaimed by you (e.g., you were not home and didn’t pick it up from the post office or customs), we will contact you. We can reship the package upon address correction, but you may be responsible for any additional shipping costs. If we cannot contact you or arrange re-delivery, we may treat it as a return.

5.11 Damaged or Lost Shipments: In the rare event your package arrives with obvious damage, please document this (take photos) and notify the courier upon receipt. Then contact us right away. We will assist in filing a claim with the shipping company. For lost shipments (no tracking update for an extended period), we will investigate and if confirmed lost, we will either resend the item (if a replacement is available) or issue you a refund. We want you to feel confident shopping with us, so we will work to make it right.

6. Returns and Refunds

We want you to be satisfied with your purchase. If you are not happy with an item or if there’s an issue, please review the following guidelines on returns and refunds:

6.1 Eligibility for Returns: Unless stated otherwise on the product page (e.g., “Final Sale” or “No Returns” for certain clearance or personal items), we offer a return option on most products. To be eligible for a return, the following conditions must be met:

– You must contact us to initiate the return within 14 days of receiving your order (based on the delivery date from the tracking). After 14 days, returns may be refused.

– The item must be in unused, unworn, and resalable condition, with all original tags, packaging, accessories, and authenticity cards (if any) included. For example, shoes should not be worn outside, and bags should have protective wrappers intact if they came with them.

– The item must not be a type of product that is excluded from returns. Non-returnable items include: intimate apparel (lingerie, swimwear without hygiene stickers, etc.), earrings (for hygiene reasons), or any custom-made/personalized items created just for you. We will indicate on the product page if an item is final sale or non-returnable.

6.2 Return Process: To initiate a return, please contact our Customer Service through email or the contact form with your order number and reason for return. We will respond with instructions, including the return address (which may be the seller’s address or our warehouse, depending on the item) and any RMA (Return Merchandise Authorization) number if required. Please do not send back items without contacting us first, as the return address can vary. When preparing your return shipment: – Pack the item securely in the original box (if possible) or a similar sturdy box to prevent damage in transit.

– Include any provided return form or the RMA number clearly inside the package, along with a copy of the invoice or order confirmation email if available.

– We recommend using a trackable shipping service for returns and purchasing shipping insurance for the value of the item. You are responsible for the item until it reaches us, and if it gets lost or damaged on the way back, we may not be able to process the refund.

6.3 Return Shipping Costs: – If you are returning an item due to a defect, damage, or because we sent the wrong item, we will cover or reimburse reasonable return shipping costs. We may provide you with a prepaid return label in such cases. – If you are returning an item for other reasons (e.g., it didn’t meet your expectations or you changed your mind), the return shipping cost is your responsibility. We can assist by providing a shipping label and deducting the cost from your refund, or you can ship it back using your preferred method (with tracking).

– Original shipping fees (the cost you paid to get the item shipped to you) are generally non-refundable, except in cases where we made an error or the product was defective.

6.4 Inspection and Refund: Once the returned item is received by the seller or our returns department, it will be inspected. If it meets the return conditions (unused, intact, etc.), we will process your refund. Please allow up to 5-7 business days after the item is received for inspection and processing. – Refunds will be issued to the original payment method you used. If you paid by credit card, the refund will go back to that card; if you paid by PayPal, it will go to your PayPal account, and so on.

– After we process the refund, it may take additional time for your bank or card issuer to post the credit to your account (often 5-10 business days, depending on their policies). – We will notify you by email once the refund has been issued.

6.5 Partial Refunds and Adjustments: If an item is returned not in its original condition (e.g., missing parts, signs of use) or past the return timeframe, we reserve the right to deny the return or issue a partial refund. For instance, if a returned shirt is clearly worn or damaged by the customer, we might decline the refund. In cases of minor packaging damage or missing non-critical tags, we may deduct a restocking fee (we will communicate this to you).

6.6 Exchanges: As a marketplace, we don’t have an automated exchange system (since inventory comes from various sellers). If you wish to exchange an item for a different size or a different product, the simplest way is to return the original item for a refund and then place a new order for the desired item. Contact us if you need assistance; sometimes we can hold a requested item or facilitate a direct swap if the seller agrees.

6.7 Defective or Not as Described Products: Our sellers are expected to check products before shipping.

However, if you receive a product that is defective or significantly not as described (e.g., wrong item, obvious flaw not mentioned, or a huge discrepancy from listing), please notify us within 48 hours of delivery for such issues. We will likely ask for a photo as evidence. In these cases, you will not be stuck with a faulty product:

– We (and the seller) will work to provide a solution – typically offering you either a full refund (and you return the item) or a replacement if available. In some cases, for minor issues, we might offer a partial refund or store credit if you are willing to keep the item.

– Any return shipping for a defective/incorrect item will be at our expense. – Our goal is to ensure you get what you ordered in the condition promised. We take such complaints seriously and may also review the seller’s performance to prevent future issues.

6.8 Return Abuse: We strive to have a fair return policy, but we also monitor for abuse. If we detect a pattern of excessive returns or behaviors that suggest wardrobing (buying items to use briefly and then returning) or other unethical conduct, we reserve the right to limit or refuse returns for that account. This would be a rare step and we would notify you if we found an issue.

6.9 Refunds for Shipping Delays: Generally, shipping delays outside our control (for example, courier delays or customs holds) are not grounds for a refund while the package is still in transit. However, if a package is lost or extremely delayed, we will work with you (as noted in the Shipping section) to either get the item delivered or issue a refund.

7. Intellectual Property and Site Content

7.1 Ownership of Site Content: All content on our website – including text, graphics, logos, button icons, images, audio clips, and software – is the property of our Company, the sellers (in terms of their product images/descriptions), or our content suppliers, and is protected by intellectual property laws. The compilation of all content on the site is our exclusive property.

7.2 License and Access: We grant you a limited, non-transferable, non-exclusive license to access and make personal use of the site. You may not reproduce, duplicate, copy, sell, or otherwise exploit any portion of the site for commercial purposes without express written consent from us. This means you can view products, print pages for your personal reference, and use our site to shop – but you can’t scrape our data to create a competing service or use our photos for your own sales, for example.

7.3 Trademarks: Our company name and logos, as well as certain product names or slogans on the site, may be trademarks of our Company or of sellers. You are not permitted to use any such trademarks without our prior written consent. All trademarks not owned by us that appear on this site (particularly the names of luxury brands referenced in product listings) are the property of their respective owners, as noted earlier, and are used on this site for identification purposes only.

7.4 User-Generated Content: If you submit content (such as reviews or comments), you ensure you have the rights to that content and you grant us a right to use it as described earlier (in Section 3.7). We may feature positive reviews or share user testimonials on our site or social media – by posting a review, you agree we can use it (without revealing your personal details beyond maybe a first name or username).

7.5 Third-Party Links: Our site may contain links to external websites or resources (for example, a blog post about fashion trends, or a link to a brand’s official site for reference). These links are provided for convenience only. We are not responsible for the content or accuracy of any third-party websites, and accessing those sites is at your own risk. We encourage you to review the terms and policies of any third- party site you visit from our links.

8. Disclaimers and Limitation of Liability

8.1 Products Disclaimer: All products sold on our marketplace are provided “as is” by the sellers, without any direct guarantees from us. While we require sellers to ensure quality and authenticity (in terms of being truthful about the replica nature), we do not make any independent warranties about the products’ materials or performance. To the fullest extent permitted by law, we disclaim any implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement. In simple terms, we do not guarantee that the product will meet all your expectations, beyond what is described in the listing. That said, if a product is found to be faulty or not as described, you have remedies as described in our Returns section.

8.2 Website Use Disclaimer: We strive to keep our website up and running smoothly, but we do not warrant that the operation of the site will be uninterrupted or error-free. There may be times when the site is down for maintenance or when technical issues occur. The site is provided on an “as available” basis. We cannot guarantee that the site will be completely free of viruses or other harmful components, but we do employ security measures to minimize such risks. Ultimately, you use the site at your own risk.

8.3 Limitation of Liability: To the maximum extent permitted by law, our Company (and its officers, directors, employees, affiliates, and agents) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the site or purchase of products. This includes, for example, any loss of profits, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages. For instance, if a delivery is late and you miss using the item for an event, we understand the frustration, but we would not be liable for any compensation beyond perhaps refunding your shipping fee if appropriate. Similarly, if you incur costs due to a product defect (like tailoring charges, etc.), we wouldn’t cover those consequential costs.

We will however try to assist you in resolving issues with those parties as part of our service.

8.6 Indemnification: You agree to indemnify and hold harmless our Company and its affiliates, and their respective officers, directors, and employees, from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of these Terms, your improper use of the site or our services, or your violation of any law or the rights of a third party.

8.7 Release: If you have a dispute with one or more sellers or other users, you release us (and our officers, directors, agents, subsidiaries, joint ventures, and employees) from claims, demands and damages of every kind and nature arising out of or in any way connected with such disputes. This means that, to the extent permitted by law, you waive any right to bring a claim against us for the actions or omissions of other users of the site.

8.8 Product Compliance: Sellers are responsible for ensuring the products they sell comply with all relevant safety, labeling, and certification requirements (for example, electronics should have proper certifications, cosmetics should list ingredients, etc. – though our marketplace at present is primarily fashion items like apparel and accessories). We make no warranty or representation as to a product’s compliance with specific laws outside of the seller’s representation. However, if you find a product is unsafe or not compliant, please notify us and we will address it with the seller and take appropriate action (including removal of the listing).

9. Governing Law and Dispute Resolution

9.1 Governing Law: These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Hong Kong (Hong Kong Special Administrative Region), without regard to its conflict of law provisions. This choice of law means that the contract is treated as if it were made and performed entirely within Hong Kong.

9.2 Jurisdiction: You agree that any dispute or claim arising out of or in relation to these Terms, or your use of the site (including non-contractual disputes or claims), shall be subject to the exclusive jurisdiction of the courts of Hong Kong. Both you and the Company consent to the venue and personal jurisdiction of these courts. If you are a consumer residing outside of Hong Kong, you may also have certain rights to pursue claims in your local courts under local consumer laws; these Terms do not limit any such rights that cannot be waived by agreement.

9.3 Dispute Resolution and Arbitration (if applicable): This section is only relevant if we implement an arbitration program. Currently, we do not mandate arbitration and hope to resolve any issues amicably.

Should a serious dispute arise, we encourage you to contact us first to attempt an informal resolution.

Often, issues can be resolved through our customer support team to the satisfaction of both parties without legal action.

9.4 Class Action Waiver: Where permitted under applicable law, you and the Company agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

10. Miscellaneous Provisions

10.1 Changes to Terms: We may update or modify these Terms from time to time. If we make material changes, we will notify users by posting the revised Terms on our website and updating the “Effective Date” at the top. In certain cases, we might also notify you via email or a prominent notice on the site. It is your responsibility to review these Terms periodically. By continuing to use the site after changes are posted, you accept and agree to the revised Terms.

10.2 Entire Agreement: These Terms (along with any other policies or guidelines referenced herein, such as our Privacy Policy and any additional terms provided for specific services or promotions) constitute the entire agreement between you and us regarding your use of the marketplace, and supersede any prior agreements or understandings, whether written or oral, relating to the same subject matter. Any waiver of any provision of the Terms will be effective only if in writing and signed by us.

10.3 Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. The remaining parts of the Terms will continue to be in full force.

10.4 No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms by us must be made in writing.

10.5 Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, sale of assets, or by operation of law.

10.6 Headings: The section titles and headings in these Terms are for convenience only and have no legal or contractual effect. They do not limit or interpret the sections.

10.7 Language: These Terms are provided in English. If we provide a translation in another language for convenience, the English version will prevail in the event of any conflict or ambiguity.
